Tesla v InterDigital & Avanci (UKSC/2025/0058/A) The Supreme Court's decision in Tesla v InterDigital & Avanci was published on 27th July. In relation to their plans to launch 5G-enabled vehicles in the UK, Tesla previously challenged the terms of the global Avanci 5G platform license, through which InterDigital licenses their standard essential patents (SEPs). Reversing previous decisions to strike out Tesla's claims, the Supreme Court has allowed Tesla's appeal, meaning that their claims may now proceed before the English court. The court held that there was a serious issue to be raised surrounding whether FRAND (fair, reasonable and non-discriminatory) obligations must be upheld when SEPs are licensed through a patent pool or licensing platform, and that it was likely that Tesla has a real prospect of being granted declarations as to whether or not the Avanci 5G platform license iss FRAND. UK courts may potentially be able to decide whether the licensing terms and rates which SEP pools offer are FRAND and, if not what the FRAND terms and rates are.
UK and Switzerland enhance Free Trade Agreement On 13th July, the government announced a new version of the UK-Switzerland Free Trade Agreement, solidifying the strategic partnership between the UK and Switzerland. Deigned with the UK's Life Sciences Sector Plan in mind, the deal highlights the UK and Switzerland's leading roles in life sciences innovation. The commitment to maintaining existing intellectual property standards will promote the discovery and development of new medicines, underpinning innovation. |
