Delays in resolving EPO Petitions for Review raise concerns

2 December 2024


When the European Patent Convention was amended in 2008 to include provisions for Petitions for Review, the procedure was intended to be as simple and short as possible so as to minimise legal uncertainty. However, since then the numbers of Petitions have increased significantly and with that so have processing times. Partner Nicholas Fox and Associate Max Ziemann investigate this worrying trend.
